These Terms of Service ("Terms") govern your use of Crown Lake Aquapark's facility, our website, our online booking system, and any related services. Please read them carefully. By using our services, you agree to be bound by these Terms.

1Acceptance of Terms

By accessing or using Crown Lake Aquapark's facilities, website, or booking services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2About Us

Crown Lake Aquapark, located at 1601 Ivory Ln, Horseshoe Bend, AR 72512, operates an inflatable aqua park, beach, mini golf, and watercraft rentals on Crown Lake. We are operated as part of Horseshoe Bend / Crown Lake KOA.

3Eligibility & Age Requirements

• Bookings must be made by someone 18 years or older, who is legally responsible for all guests in the booking.
• The aqua park (inflatable obstacle course) requires guests to be at least 6 years old.
• Children ages 6–13 must have a parent or guardian on-site during their session.
• All guests using the aqua park must be physically able to swim or wear a Coast Guard-approved life jacket. Life jackets are provided at no charge and are required for use of the course.
• We reserve the right to deny access to any guest whose participation could compromise their safety or that of others — including signs of intoxication or unfit medical condition.

4Bookings, Payment & Pricing

• All bookings are made through our online booking platform (Wakesys) or at the on-site booth, subject to availability.
• Prices are listed on our website and at the entrance. Prices may change without notice; the price displayed at the time of booking is the price you pay.
• Applicable sales tax is added at checkout.
• Payments are processed securely through Stripe. We accept major credit and debit cards.
• A booking is not confirmed until payment is successfully completed and you receive a confirmation email.

5Cancellations, Refunds & Reschedules

Weather closures

If we close the aqua park due to lightning, severe weather, or other safety conditions, we will work with you to reschedule at no charge or, at our discretion, issue a full credit to your prepaid account.

Guest-initiated cancellations

Cancellations made 24 hours or more before your session start time are refundable, minus a 25% processing fee. All refunds are issued as credit to your prepaid account on file — credits do not expire and can be applied to any future booking. Refunds are not returned to the original payment method.

Cancellations within 24 hours of the session start time are non-refundable.

No-shows

Failure to arrive for your session without prior cancellation forfeits the session and no refund or credit will be issued.

Private parties and buyouts

Specific cancellation terms are noted in your booking confirmation. A deposit of $150 or 50% (whichever is greater) is non-refundable within 14 days of the event.

Operational closures (non-weather)

In the rare event we cannot operate, we will issue a full refund or credit to your prepaid account.

6Waivers & Assumption of Risk

Use of the aqua park involves inherent risks including, without limitation: falls, collisions with equipment or other guests, water-related injuries, exposure to weather and lake conditions, and equipment failure. By participating, you acknowledge and accept these risks.

7Rules of Conduct

While at our facility you agree to:

• Follow all posted rules and lifeguard instructions at all times
• Wear a Coast Guard-approved life jacket while on the aqua park
• Not consume alcohol on the aqua park or while operating rented watercraft
• Refrain from disruptive, dangerous, harassing, or unlawful behavior
• Respect other guests, our staff, and the property

Violation of these rules may result in immediate removal from the facility without a refund, and may result in being banned from future visits.

8Rentals

• Kayaks, canoes, paddleboards, and pontoon rentals are subject to availability and weather.
• Renters are responsible for damage caused beyond normal wear and tear, except where the damage results from a defect in the equipment we provided.
• All life jackets and paddles are included at no extra charge and are required to be worn at all times while on the water.
• Rentals are operated at the renter's own risk, subject to the same waiver requirements as aqua park access.

9Photo & Video Release

By entering our facility, you acknowledge that Crown Lake Aquapark may capture photos and video for promotional, training, and operational purposes (including security).

You consent to the use of your likeness in our marketing materials (website, social media, advertisements). If you do not consent, please notify staff upon arrival and we will use reasonable efforts to exclude you from public-facing content.

You may not commercially distribute photos or video taken at our facility (including drone footage) without our prior written permission. Personal social-media sharing is welcome — and encouraged.

10Lost & Found

Crown Lake Aquapark is not responsible for lost, stolen, or damaged personal property. We maintain a lost-and-found at the entrance booth — items unclaimed after 14 days will be donated or discarded.

11Intellectual Property

All content on our website and at our facility — including logos, photographs, graphics, written copy, and the "Crown Lake Aquapark" brand — is owned by Crown Lake Aquapark or its licensors. You may not copy, reproduce, or use any of it commercially without our prior written consent.

12Disclaimer of Warranties

Our services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

13Limitation of Liability

To the fullest extent permitted by law, Crown Lake Aquapark, its owners, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of our services. Our total liability for any claim will not exceed the amount you paid for the specific booking giving rise to the claim.

Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for gross negligence or willful misconduct.

14Indemnification

You agree to indemnify and hold harmless Crown Lake Aquapark from any claim, loss, or expense (including reasonable attorneys' fees) arising from your violation of these Terms, your violation of the waiver, or your unlawful or negligent acts at our facility.

15Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Arkansas, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Izard County, Arkansas, and you consent to personal jurisdiction there.

16Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
